3. Permission to use the website

10. Changes and termination

You may stop using the website at any time. Provisions that should reasonably survive the end of use, including intellectual-property, liability and dispute-resolution provisions, remain applicable to the extent enforceable. 11. Governing law and court proceedings

This does not override a qualifying small-claims option, a mandatory right to proceed in another forum or another applicable consumer protection. Attorneys' fees may be awarded only where authorized by law or an enforceable agreement.
12. Disputes, arbitration and opt-out

Include your name, a way to contact you, a description of the concern and the relief requested. Both sides agree to make a good-faith effort to resolve the dispute informally. This process does not prevent urgent relief, a qualifying small-claims case or action needed to preserve a legal deadline.
Individual arbitration
Except for the exceptions below or a timely opt-out, disputes arising from these Terms or your use of the website will be resolved by binding individual arbitration administered by JAMS under the rules and consumer standards applicable to the dispute, to the extent this agreement is enforceable. The arbitrator may award relief available under applicable law, subject to the valid limitations in these Terms. Judgment on an award may be entered in a court with jurisdiction.
Arbitration may take place remotely, in the United States county where you live or work, or at another location both sides agree to, consistent with applicable consumer standards. We will pay an additional filing cost to the extent your required arbitration filing fee would otherwise exceed the cost of filing the claim in court, and any other amounts required by applicable law or the administrator's consumer standards.
Arbitration generally replaces a court trial, including a jury trial, and judicial review may be limited. The allocation of authority between a court and an arbitrator is governed by applicable law; these Terms do not remove questions a court must decide by law.
Class-action waiver
To the extent permitted by law, covered disputes will be pursued only on an individual basis, not as a class, collective or representative action. This does not waive a remedy that cannot lawfully be waived. If the class-action waiver is found unenforceable in a way that would require class arbitration, the arbitration agreement will not apply to that dispute unless both sides separately agree otherwise.
Exceptions
Either side may bring an eligible individual claim in a small-claims court with proper jurisdiction, including where you live or work. Either side may seek appropriate court relief for misuse of intellectual property or an urgent security matter where permitted. Nothing prevents a report to a government agency or participation in a process the law protects.
Your 30-day opt-out right
You may opt out of the arbitration agreement and class-action waiver by emailing info@trustybathroomremodelingchicago.com with the subject Arbitration Opt-Out within 30 days after first agreeing to these Terms. Include your name, contact information and a clear statement that you opt out. No account registration is required. If you opt out, neither side is bound by the arbitration agreement, and the other Terms continue to apply. Exercising this opt-out does not affect your ability to use the website.
13. General terms
These Terms and any notices expressly incorporated into them form the agreement concerning your use of this website. They do not replace your separate contract with an independent contractor. A failure to enforce a provision immediately is not a waiver of the right to enforce it later.
If a provision is invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law, subject to the specific arbitration rule above. You may not transfer your obligations under these Terms without permission, except where law permits. We may transfer the agreement in connection with a lawful business reorganization or asset transfer, subject to applicable consumer and privacy protections.
